Date: ______________ Time:________________ Agency No. __________________ This Letter of Agreement is made this date between Anchor Investigations and ___________________________________ herein after referred to as the client. The client hereby employs Anchor Investigations it's agents and employees, for the consideration of $__________ Per Day to undertake certain investigative duties concerning the undercover investigation of: 1. A MINIMUM of three (3) days is required for surveillance investigation. No investigative duties will be initiated until Anchor Investigations receives your CASE PAYMENT and a signed copy of this agreement. Clients will receive the case evidence and further instructions via Mail, Telephone or Fax Transmission. The taking of depositions and court-ordered testimony shall not be considered part of this investigation. A set rate of $300.00 PER COURT DAY, PER INVESTIGATOR is required and shall be payable in advance before the established deposition date or court date. Upon receipt of the above stated deposition and court fees Anchor Investigations agrees to appear in court and cooperate fully with the client and his/her attorney concerning this evidence. Other justifiable expenses, to include mileage, hotel, travel time, air fares per investigators will be assessed to the client. The client will be informed of these additional expenses before the deposition /court day. 2. Anchor Investigation agrees to prepare a written report, present evidence, sworn statements and all pertinent information's for the client in regards to the above stated Investigation, Research or Surveillance. Anchor Investigation shall at all times have the right to refuse to engage in conduct which, in the judgment of it's management, is improper, illegal, or involves too great a personal risk to the investigator. 3. CREDIT BACKGROUND, If Required - Request must be accompanied by the special waiver "Authorization to Conduct a Financial Background Investigation." The client will release this agency from any responsibility for liability or damages, which may occur as a result of the disclosure of this information. 4. Anchor Investigation has right to refuse any request for work. It is understood, that by submitting this agreement, work request, you (hereafter referred to as the CLIENT) and agree to use this information for legal purposes only and accept all responsibility for its use. Anchor Investigations will not be held responsible for, or liable, directly or indirectly, by any client or parties, your organization, employees or affiliate use of any or all of the information provided by Anchor Investigation to you the CLIENT. The client agrees to indemnify and hold Anchor Investigations harmless for all damages, claims, or losses suffered as a result of claims by third parties relating to client and users' use of the data provided by Anchor Investigations. Anchor Investigations shall be indemnified from any and all claims and consequences arising out of found or not found information. 5. If you, your company, organization and your purpose for hiring Anchor Investigations is misrepresented, any misrepresentation of information made to Anchor Investigation and/or withheld by the client that is pertinent to this investigation will render this contract null and void. You the client understand that misrepresentation in this agreement may results in civil and criminal action against you, your organization, employees and affiliates. Anchor Investigations cannot and does not make any guaranties as to the results your investigation. Client bears full legal costs in event of suit and further will hold all information confidential and held strictly confidential to the fullest extent permitted by law. You also understand that your identity and information provided may be checked before any case-work information is submitted/released to you. The use of the information obtained from Anchor Investigation in the course of or planning of stalking, identity theft or fraud is explicitly prohibited and will be reported to the authorities 6. In the event of default of case payment and this agreement will be placed in the hands of an attorney at law for collection. Upon default of case payment the client will surrender his/her case confidentially and information may be made public. I/We the client agree to pay all cost of collections, including, but not limited to, a reasonable attorney's fee. 7. If necessary, in the course of the clients authorized case work Anchor Investigations may need, require and authorize the use of a CI -Confidential Informant's). The client will be informed of this agencies decision to use a Confidential Informant which may be critical to legally gather information. Anchor Investigation will not manufacture or distribute a false identification to the Confidential Informant. The manufacturing, distribution and possession of false identification is considered a felony. The identity of a Confidential Informant is strictly confidential and will not be released to the client. Anchor Investigation may or may not release (all) or (in part) this information to the client. But upon this agencies decision to release (all) or (in part) of certain information acquired by the Confidential Informant TO-THE CLIENT, the client is prohibited and may not under any or all circumstances, disseminate, use, sell or trade this information directly or indirectly to inform authorized or unauthorized individual without the expressed permission of Anchor Investigation. The release of information may include certain dates, time locations or statements gathered by the Confidential Informant which would identify the Confidential Informant to unauthorized parties. In all circumstances Anchor Investigation must be notified by the client if he or she may need to utilize information obtain by Confidential Informant and released by Anchor Investigation.. Only under the express permission BY Anchor Investigations can this information obtained by the Confidential Informant be released. If Anchor Investigations obtains evidence or proof or statement from authorized or unauthorized parties that the client has disseminated, used, sold or traded information obtain by the Confidential Informant, that certain dates, times, locations and or statements are know by other unauthorized individual or parties, the clients surrenders case confidentially and this case information will be placed in the hands of a attorney of law for the collections of damages in the amount of Two Hundred and Fifty Thousand dollars. Any and all attorneys fees required by Anchor Investigations in the collection of this breech of confidentially will be also assed to the client in addition to the Two Hundred and Fifty Thousand Dollars fee. The personal safety and identity of the Confidential Informant will not be jeopardized by client for any reason or under any circumstances. 8. If you agree with the terms of this agreement, please sign this letter and return this original via Mail or Fax to the above stated address or facsimile. UPON RECEIPT OF THIS AGREEMENT, Anchor Investigations will initiate the above stated case work. We cannot, will not begin your case work until this contract agreement is signed and dated and case fees are received and verified.. The above arrangements will continue until completion, unless terminated by the client through verbal, telephone or written correspondence. Once the case work is initiated "Early Termination" of this work agreement by the client will be viewed as completed work. Under no circumstances will client be reimbursed for the minimum day case-fees due to early termination of the agreement. Client may receive, be reimbursed for their case fees /funds due to early termination of this agreement if the clients authorization to terminate this work agreement or case work is received through verbal, telephone or written correspondence to Anchor Investigations BEFORE the initial case work "start date" authorized by the client. |
